1. Acceptance of Terms

By accessing or using BookOfMe ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

2. Description of Service

BookOfMe is an AI-powered platform that creates personalized, illustrated storybooks for children. Users create character profiles by providing text descriptions only—we do not collect or store photos of children. All illustrations are AI-generated fictional artwork based on text descriptions.

3. Eligibility

You must be at least 18 years old to create an account and use this Service. By creating an account, you represent and warrant that you are at least 18 years of age. The Service is designed for adults (parents, guardians, family members) to create content for children—not for children to use directly.

4. Account Registration

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorized use

5. Credits and Payments

BookOfMe uses a credit-based system for story generation:

  • New users receive 15 free credits upon registration (enough for 1 free Epic story)
  • Additional credits can be purchased through our platform via Stripe
  • All purchases are final. Credits are non-refundable and non-transferable
  • Credits do not expire as long as your account remains active
  • Prices are subject to change with reasonable notice

6. User Content

You retain ownership of text content you provide (character descriptions, story ideas). By using the Service, you grant us a non-exclusive license to use this content solely to provide the Service to you.

You agree not to submit content that is:

  • Illegal, harmful, threatening, or inappropriate for children
  • Infringing on intellectual property rights of others
  • Containing personal information of others without their consent
  • Designed to circumvent our content safety measures

7. AI-Generated Content

Stories and images generated by our AI are created for your personal, non-commercial use. You may share these with family and friends.

Important Disclaimers:

  • AI-generated content may occasionally contain errors, inconsistencies, or unexpected outputs
  • Generated images are fictional artistic interpretations, not photographs or likenesses of real people
  • We do not guarantee that generated content will meet your specific expectations
  • Commercial use of generated content requires separate written licensing from BookOfMe

8. Content Safety

We employ AI safety measures to ensure all generated content is age-appropriate. However, no AI system is perfect. If you encounter any inappropriate or concerning content, please report it immediately to support@bookofme.io and we will investigate promptly.

9. Prohibited Uses

You agree not to:

  • Use the Service for any illegal purpose
  • Create content depicting real individuals without their consent
  • Attempt to bypass credit requirements or exploit the system
  • Resell or redistribute generated content commercially without authorization
  • Use automated tools, bots, or scrapers to access the Service
  • Reverse engineer or attempt to extract our AI models or algorithms
  • Interfere with the operation or security of the Service

10. Intellectual Property

The Service, including its design, features, and underlying technology, is owned by BookOfMe and protected by intellectual property laws. You may not copy, modify, or create derivative works of the Service itself. Your license to use generated content is limited to personal, non-commercial purposes unless otherwise agreed in writing.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

12. Indemnification

You agree to indemnify, defend, and hold harmless BookOfMe and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.

13. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately. Unused credits are non-refundable upon termination.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts located in Delaware.

15. Changes to Terms

We may update these Terms periodically. We will notify you of material changes by posting the new Terms on this page and updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
